Eric Rossini's Attorney: It's a Custody Battle Gone Bad

Eric Rossini, owner of MassDojo in Shrewsbury, was back in court to face sexual assault charges against a family member.

Anthony Salerno, Eric Rossini's attorney, says that the Rossini case is a custody battle gone very wrong.

"Eric's ex-wife wanted to take the kids away from him in Massachusetts and then this case was filed against him in Texas, where she was at the time," said Salerno who was in Westborough District Court with Rossini, the owner of , this morning.


Rossini faces two counts of indecency with a child by sexual contact, according to Tiara Ellis Richard, media relations coordinator for the Arlington Police Department.

After his arraignment in May, Rossini posted bail and was placed under house arrest.

Salerno said Rossini wants to go to Texas as soon as possible to clear up the charges against him, but going to Texas would violate his conditions of release.

"Judge Virzi ordered him under house arrest, so the judge here today wants to wait until Judge Virzi can rule about going to Texas," Salerno said.

The district attorney's office said that Rossini can waive rendition and be immediately put into custody to face the charges in Texas.

"I've seen cases like this, and the accused ends up waiting in jail for a long time while the other jurisdiction comes to get them," Salerno said. "Eric would like to go as soon as possible because we are 200 percent sure that the Texas charges will be dropped."

Rossini is the owner of the karate dojo in Shrewsbury. .

Rossini was in court today, and will be back in court on July 13, when Virzi can rule on the motion to give him two to three days to travel to Texas to face the charges.

"This is a catch-22," Salerno said. "He wants to clear this up, but he can't leave because he's under house arrest."

All criminal child sex charges in Texas are brought by the prosecution via Indictment. And just because Rossini's case involves a custody battle does not necessarily mean the charges are false. Dean Tong

No it does not mean that the charges are false but a D.A. can get an indictment from a grand jury with very thin evidence, especially when the accusation is a child sex charge. The mere existence of an indictment does not equal guilt. The custody issue does muddy the waters as I'm sure many of us have heard of inaccurate accusations coming from two parties who are not amicably splitting up. I hope the facts of this case come to light as it moves through the system. If Eric committed the crimes, I hope he is punished, if he didn't then I hope his innocence is given as much attention as the accusations have been.

He is innocent until proven guilty and an indictment does not necessarily indicate guilt but from what I understand about indictments in cases such as these, in order to even send the case to the grand jury, the potential victim in the case has to make the accusation. It would not be enough for the ex-wife to accuse - the child would have to corroborate and make a statement - especially one who is 12 years old. I didn't have a great relationship with my father and honestly he's kind of a jerk in general but it would have taken some kind of bad dynamic for me to accuse him of something like that if it weren't true. Again even if the child has made a statement, it does not necessarily mean the guy is guilty. But given his prior domestic assault, his clearly bad relationship with his ex-wife (and apparently his child who I would guess is female) he is either the unluckiest guy in the world or he seems to have really bad relationships with the women in his life. Again not trying to start something with his friends who are posting here. Just expressing an opinion. I hope it's not true especially for the child's sake. Sounds like either way she has some issues to deal with. Hope she is getting the help she needs whatever that may be.

Rossinis bitter divorce began almost a decade ago. This is made out to seem like they just split up. Rossini has had many years to move on from the post divorce but just can't seem to establish any real relationships with others without violence. If he was criminal justice major in college why didn't he pursue law enforcement? Hmm, can someone can psych exam. It just doesn't suggest any actual issues relating to a custody battle. It appears he lost the custody battle years ago and has not accepted reality. Why would a pre-teen manufacture sexual CONTACT accusations about Dad? This guy should have a scarlet letter embroidered on his bathrobe in the Texas state penn, maybe his kids will forgive him if he gets the help he obviously needs so much.

a very good manipulative woman can get her kids to do just about anything with promises of better things to come if successful....innocent until proven guilty....hes a successful man and seems to be a poor choice of character or very naive when it comes to women....what easier, quicker, more believeable way for a spiteful jilted woman to take down a martial arts instructor but by accusing him of abuse? sound fishy to you? it does to me....the ex wife wants to move the kids out of state, but cant because of Eric..she needed to get rid of the father, aside from him dying, this was the next best way for her..have him put away..thats what she set out to do and is trying her best...
